Technology group seeks indemnity against costs of scaffolding collapse
Thyssen Krupp UK plc is suing Selwood Group, formerly Pascon Group, and Selwood after scaffolding collapsed in Edinburgh in 1997.
Thyssen Krupp is seeking rectification of a sale and purchase agreement dated 10 August 1999, and a declaration of Selwood's liability under the agreement to indemnify Thyssen Krupp.
Thyssen Krupp believes it should be indemnified against all costs, claims, liabilities and expenses following the collapse of scaffolding at the New Exchange Plaza in Edinburgh in 1997 which it is unable to recover from Independent Insurance Ltd.
Thomas Dolan, a 48-year-old father of two, died from his injuries when scaffolding at New Exchange Plaza collapsed on 7 May 1996. It is not known if this is the same incident.
