Writ says Roxan overpaid sub-contractor Finlay Breton for work on 55 new flats on south coast

好色先生TV contractor Roxan Construction is headed for a High Court showdown with sub-contractor Finlay Breton in a row over a site at Bournemouth.

Finlay Breton agreed to design and install concrete floors, balconies, and staircases to the 55 new flats at The Reef in Boscombe Spa Road, for a price of 拢290,980, according to a High Court writ.

Work started in May 2005, and Southampton-based Roxan made various interim payments, paying a total of 拢420,052.60, and work was finished in February 2006, the writ says.

But Roxan says the final value of Finlay Breton鈥檚 work was 拢305,646.95, and argues that it had been paid more than 拢114,405.65 too much.

Finlay Breton, of Wells, Somerset, has refused to repay the overpayment, and with VAT, the total in dispute is 拢134,426.63, the court will hear.

Now Roxan is claiming damages and repayment of the sum overpaid, as well as interest.

The writ was issued by Paris Smith and Randall of Southampton.
