Ruth Kelly’s embarrassing climbdown over HIPs hasn’t stopped RICS from threatening to take the government to court.

RICS has suspended its legal action against the government over Home Information Packs but says it will ‘reactivate’ the judicial review if the government does not ‘deliver on its obligations’.

For sale signs
  • RICS says it has only agreed to the ‘stay’ of the Judicial Review on the following terms:
  • The Government provide a 12 week consultation period on EPCs
  • The Government publish a Regulatory Impact Assessment (including a full cost-benefit analysis)
  • The Government pay RICS' legal costs.
Has RICS got a point or should they drop their action?
